1) Misconductof Shri Rajiv Lal, Deputy Director
Incharge, SRO Shahdara, Delhi byMisleading Hon’ble Director General, ESIC
and Police Authorities by giving wrong facts in the fabricated case of
claim of benefit to Late (Sh) Rakesh Mishra worker of M/s Anmol Enterprises
for seeking permission for filing FIR in the case.
2) Concealing of fact that not only identity of
covered Insured Person was unlawfully transferred but the identity of
covered Employer was also unlawfully transferred.
3) By doing so the delinquent Employer was blessed
with ground of defense for disputing the claim of widow of diseased worker
in Workmen Compensation Court against unlawful considerations.
4) Compliance status of various employers with
whom the Original Insured Person was associated were concealed so that no
defaulter action could be initiated against them.
5) The Deputy Director I/c while being a public
servant framed incorrect document while filing a complaint in Police
Station with the Criminal Intent of favouring delinquent Employers and in
the process causing injury to Mrs. Malti Devi, Widow of Late (Sh) Rakesh
Mishra by wrongly declaring employer as bona fide registered employer which
is a criminal offence under Section 167 of IPC (Act XLV of 1860).
6) The Deputy Director I/c made complaint for
filing FIR (document) containing many false facts and statement, intending
that such false statement may appear in evidence in a judicial proceeding
or in a proceeding taken by law before a Public Servant as such and that
such false statement so appearing in evidence, may cause any person who in
such proceeding is to form an opinion upon the evidence, to entertain an
erroneous opinion touching any point material to the result of such
proceeding. This conduct of Deputy Director I/c is also a criminal
offence under Section 192 of IPC (Act XLV of 1860).
